Is it fair

I know a family that has had some imagration problems from Canada. The father a canadian citizen and his wife a american citizen, they have a two year old child and a baby on the way. when they got married they would have applied for bringing a family member to the states visa but they did not have the money. So the new husband and father to be just applied for a visitors visa. After some time he went back to Canada to work for two months for his brother to get some more money to applie for perminate residance. Opon his return he was stopped at the border because he visa had expired. He tried again the next day with out his baggage and was stopped again by armed gards and forced to stay in the country. Now he has to wait six months to a year to do anything when he finally was trying to things ligitamently they wont let him but for years before this he never was bothered to try and stay perminatly by either country.

This is really a sad situation. Sounds like they need a good lawyer. What do you think is a viable solution?
